While it is unlikely that a non-parent would obtain child custody, it is possible. Grandparents, aunts, uncles, or other relatives may receive child custody if both parents agree to the arrangement or if a judge rules that it would be in the best interest of the child. This most often occurs when the parents of a child are deemed unfit for reasons that may include drug and alcohol use, abuse, etc.
However, in order for a non-parent to obtain child custody, they must convince the court that they have an existing relationship with the child. Furthermore, the non-parent must prove that being granted child custody would be in the child’s best interest.
