My spouse wants a divorce. Can I oppose the divorce?

No. Under United States divorce laws, you cannot stop your spouse from filing a divorce. A divorce will be granted by a judge whether or not you agree to the decision, take part in the legal divorce proceedings, or sign the final paperwork.

Every state in the U.S. has its own divorce laws and rulings, which establish grounds for filing for a divorce. However, every state follows the “no fault” divorce standard, which allows a spouse to divorce you at any time without proving what the other spouse did wrong.

In a “no fault” divorce, the spouse can state a reason for the divorce that is recognized as grounds for dissolution. In fact, in many jurisdictions, a court will not accept any reason other than “irreconcilable differences” or “incompatibility” as the reason for divorce. Objecting to a spouse’s dissolution request is an irreconcilable difference that justifies the grounds for a divorce.

For more information about divorce laws, it is wise to seek the advice of an experienced divorce attorney who will protect your legal rights and maximize your interests. Contact us today to speak with a qualified attorney free of charge.
