How Does a Collaborative Divorce Work?

Collaborative divorce, often referred to as the “good divorce,” is an amicable, more cost-friendly route many divorcing couples are choosing to take these days. The following are steps both parties usually take in a collaborative divorce:

  • Each spouse finds a qualified divorce lawyer who is trained and experienced in collaborative divorce.

  • The divorce lawyers contact each other and discuss whether the process can be handled collaboratively.

  • All parties including the divorcing spouses and their attorneys meet to sign contracts that prevent them from litigating. If they do decide to take their case to court at a later date, the collaborative divorce lawyers are no longer allowed to represent them, and the process starts anew.

  • Several mediation-type meetings are scheduled to discuss and exchange information about finances, children, etc.

  • The spouses are encouraged to find a support team of divorce coaches such as a neutral financial advisor, mental-health professionals, and a child advocate.

  • The divorce lawyers draw up the appropriate paperwork that outlines the terms of the collaborative divorce. Both spouses sign them and the documents are filed in court.
