Let us help you locate an attorney. Use the form below to find a divorce attorney in your area.

Do uncontested divorces require court hearings?

Depends on the jurisdiction. In some states, hearings are required, but they’re generally quick and painless.

In other jurisdictions, your part in an uncontested divorce can be handled completely on paper and your lawyer can take care of all the court proceedings without you.

Either way, for uncontested divorces, even though they are “uncontested,” the attorney you choose will only be able to represent one of the divorcing spouses, and you will have to tell the lawyer which one it will be right from the beginning.

Typically, the divorcing spouse in need of the most help should be the plaintiff – the one represented by the lawyer.

The attorney will prepare all the paperwork for you and your, and then hand it over to you for your signatures.

In many states, once the documents are signed, the attorney can file them for you without you ever having to set foot in court.

In other states these uncontested divorce cases get pushed through the court system relatively routinely, quickly, and painlessly.

You will most likely have to pay filing fees either way, but an uncontested divorce is often among the least costly kind.
