Prenups Gaining Popularity Among Baby Boomers

A new survey reveals that prenuptial agreements are no longer for wealthy men wanting to protect their financial assets. According to the American Academy of Matrimonial Lawyers, premarital agreements are increasing in popularity among baby boomers.

“Baby boomers are often entering their second or third marriage. They’re a bit more worldly, and they often have significantly more assets than younger folks getting married,” said Cheryl Lynn Hepfer, president of the AAML.

Eighty percent of the divorce lawyers surveyed said they saw an increase in the number of prenuptial agreements over the past five years. They believed the surge to be largely due to divorcees trying to avoid mistakes made in previous splits.

“[The pacts] are a vaccine against the disease of divorce. It’s the vogue today. It’s the product of divorce being expensive and intrusive,” said New York divorce lawyer Raoul Felder.

The survey also revealed that the demands made in prenuptial agreements are not always traditional. While the majority of prenuptial agreements include conditions pertaining to financial matters, some include stipulations involving pets, sex, household chores, weight gain, and more.

“These are things that are almost impossible to police and enforce,” said Manhattan divorce lawyer Jeffrey Cohen. Most lawyers agree the more outrageous the demands, the more difficult they are to enforce.
