Broken System Leads to Harder Divorce

For many couples going through a divorce, the process can be heartbreaking, expensive, and very time consuming.

Divorce experts say all of this can be heightened in the state of New York, one of the few states where a “no-fault” divorce law is not implemented.

“No-Fault” Divorce Law

With the “no-fault” divorce law, one party is able to obtain a divorce without giving any reason as to why the marriage should end.

As a result, couples who are going through a divorce in New York often find themselves creating untrue scenarios just to get out.

According to reports, some spouses use their assets and children as bargaining tools to get the most out of their divorce.

Families Left Broken

The process of getting a divorce in New York is often such a strenuous one that families are left broken and almost always bitter towards one another.

In one case, three New York judges refused to grant a couple a divorce even though the man was no longer living with his wife and hadn’t in five years.

Many Dispute New York Laws

According to many, both couples in healthy marriages and those going through a divorce, the fact that New York does not recognize the “no-fault” law deprives residents of their rights

“It is a terrible disadvantage to the people of the state,” says Sondra Miller, a retired appellate court justice. “There is no way that many people who have dead marriages can extricate themselves.”
