Same-Sex Couples Face Issue of Divorce

Although same-sex couples have crossed the marriage hurdle and will be legally accepted in California, the question now arises of what happens when they want to divorce?

This is simply one of the many issues that have arisen since same-sex marriage was legalized on the West coast.

However, many believe the issue of divorce may be the most important issue at hand.

Once Marriage Hits a Bump

Just last month, a court ruling in California permitted same-sex marriages throughout the state.

The ruling will even allow people from other states to be legally wed in California since the majority of the country has not legalized same-sex marriages.

However, now many are questioning how this ruling applies to divorce laws, since marriage hasn’t been deemed to be always easy.

Fine Lines Drawn

Some gay and lesbian couples throughout Massachusetts, Canada, and under civil unions from Vermont, believe they may be in legal limbo in terms of divorce in other states.

Apart from the issue of divorce, other potent issues such as employee benefits, bankruptcy filings and employee benefits are also in question.

Joanna Grossman, a law professor at Hofstra University School of Law in New York says that she has been contacted by more than 50 people who have entered into Vermont civil unions and now want out.
